Determination of Censure

As Published in the 1990 Annual Report

On review, the Court of Appeals rejected the censure and dismissed the charges on grounds pertaining to the Commissions' jurisdiction in cases involving judicial delay in rendering decisions. In Matter of Gilpatric, 13 NY3d 586 (2009), the Court affirmed the Commission's jurisdiction in such cases, noting inter alia that "after nearly twenty years of experience with Greenfield, we think it is not workable to exclude completely the possibility of more formal discipline for [delays], in cases where the delays are lengthy and without valid excuse." 13 NY3d at 589-90.
